OFFICIAL RULES AND REGULATIONS
May 23, 2024 to July 29, 2024
NO PURCHASE NECESSARY. CONTEST OPEN ONLY TO LEGAL RESIDENTS OF ONTARIO WHO ARE 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY.
The Lotto Max X CEBL- Path to Playoffs Contest (“Contest”) commences on May 23, 2024 at 5:00 PM ET and ends on July 29, 2024 at 1:00 PM ET (the “Contest Entry Period”). By entering this Contest, entrants accept and agree to be legally bound by these Official Rules and Regulations.
There are a total of four (4) Prizes available to be won in this Contest, each of which is allocated to one of the four CEBL Ontario Teams as set out below. Entries will be associated with only one Team draw in accordance with the Eligible Purchase or NPN Request. By way of example only, if an Eligible Participant makes an Eligible Purchase in association with a Brampton Honey Badgers home game, any Entries associated with that purchase will be allocated solely as part of the Brampton Honey Badgers draw (each, a “Team Draw”). Odds of winning any Prize depend on the total number of Entries received in association with a specific Team Draw.
1. ELIGIBILITY:
The Contest is only open to legal residents of the Province of Ontario, who are eighteen (18) years of age or older at the time of entry (“Eligible Participant”). Employees of the Canadian Elite Basketball League (“CEBL”), Ontario Lottery and Gaming Corporation (“OLG”, and together with CEBL, the “Contest Sponsors”), the Alcohol and Gaming Commission of Ontario (“AGCO”), the CEBL and its member teams, (together, the “CEBL Parties”), and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, agents, their advertising and promotional agencies (together with the Contest Sponsors, the “Released Parties”) are not eligible to enter the Contest. Determinations of eligibility shall be made in the sole discretion of the Contest Sponsors.
2. HOW TO PARTICIPATE:
NO PURCHASE NECESSARY. There are two ways to earn Entries as set out in more detail in this Section 2:
a) With Eligible Purchase: Eligible Participants can earn Contest Entries by taking the following actions:
Upon successful completion of steps 1 and 2 above, an Eligible Participant will earn one (1) entry per Eligible Purchase into the specific Team Draw associated with the purchase (each an “Entry” and collectively “Entries”). Each Eligible Purchase, regardless of the number of tickets purchased, can only be used to gain one (1) Entry. Season tickets, flex packs, voucher packs, group tickets and promotional tickets do not qualify as an Eligible Purchase and cannot be used to gain Entries.
b) No Purchase Necessary (“NPN”): In order to earn one (1) Entry into a specific Team Draw without making an Eligible Purchase, an Eligible Participant must take the following steps:
There is a limit of ten (10) Entries per Eligible Participant during the Contest Entry Period. In no event can an Eligible Participant combine the purchase and no purchase methods of entry to obtain more than ten (10) Entries.
An Entry will be declared invalid if it is incomplete, damaged, irregular, or mechanically or electronically reproduced. If it is discovered by CEBL (using any evidence or other information made available to, or otherwise discovered by, CEBL) that any person has attempted to use (or attempt to use) multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter the Contest more than once or to otherwise participate in or disrupt this Contest, they may be disqualified from the Contest, and any future contests of CEBL, in the sole discretion of CEBL. The sole determinant of time for the purposes of this Contest, including receipt of a valid entry, will be the Contest computer servers.
If the identity of an Eligible Participant is disputed, the authorized account holder of the email address associated with the Entry in question will be deemed to be the participant for the purposes of the Contest. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder.
CEBL reserves the right, in their sole discretion, to require proof of identity and/or eligibility (in a form acceptable to CEBL – including, without limitation, government issued photo identification): (i) for the purposes of verifying an Eligible Participant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an Entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason CEBL deem necessary, in its sole discretion, for the purposes of administering this Contest in accordance with these Official Rules. Failure to provide such proof to the satisfaction of CEBL in a timely manner may result in disqualification of the Eligible Participant, in the sole discretion of CEBL.
3. PRIZES:
There are four (4) Prizes available to be won during the Contest Entry Period (each a “Prize”, collectively the “Prizes”), one per Team Draw. Limit of one Prize per Eligible Participant. The Prizes are as follows:
The Prizes include only those elements described above. Any items, incidental costs, or expenses not expressly specified herein shall be the responsibility of the Selected Entrant. A Selected Entrant is not entitled to reimbursement for any costs or expenses they incur relating to redeeming or making use of a Prize.
Return air transportation will be provided only from airports in Ontario. Selected Entrants located in the Ottawa region may, in the sole discretion of the Contest Sponsors, be provided the option of train travel to Montreal in lieu of airfare.
The Selected Entrants and their guests acknowledge and accept all risk of damages, injury or other loss incidental to any game for which tickets are issued, whether occurring before, during or after the game, and hereby voluntarily agree to assume the same. CEBL reserves the right to refuse admission and/or to expel from a game and/or any other aspect of the Prize, any person whose conduct is deemed by them to be objectionable. Participation in the Prize is subject to compliance with all applicable laws, by-laws, regulations and any applicable facility or carrier rules; failure to comply may result in non-admission or expulsion from further participation in the Prize.
The Selected Entrant is not entitled to any difference between the actual value of the Prize and the approximate retail value stated herein. Each Selected Entrant must follow all directions of CEBL with respect to the Prize or any aspect thereof. Failure to do so may result in termination of participation, or continued participation, in the Prize or any aspect thereof. The Prize must be accepted as awarded without substitution and is not transferable, refundable, for resale or convertible to cash. CEBL reserves the right, in the event that the Prize, or any component of the Prize, cannot be awarded as described for any reason, to substitute the same for another prize or component of equal or greater value, without notice or liability. In the event that a substitute prize is awarded, such prize must be accepted as awarded and cannot be exchanged for cash or otherwise.
All costs or arrangements associated with the use of the Prize, including but not limited to, travel, transportation, parking, accommodations, merchandise, food and/or beverages, are the sole responsibility of the Selected Entrant and are not included with any Prize. Prize may be subject to additional restrictions or regulations, including governmental or venue restrictions. CEBL have no responsibility or liability if (i) any element of the Prize is canceled, suspended, delayed or rescheduled for any reason or (ii) the Selected Entrant cannot participate in any element of the Prize due to any reason whatsoever.
4. WINNER SELECTION:
At approximately 1:00 PM ET on July 30, 2024 following the end of the Contest Entry Period, four (4) random Team Draws will be conducted from all Entries received for each Team Draw and one (1) Entry per Team Draw will be selected (each, a “Selected Entrant”) to be eligible to win a Prize. The Team Draws will take place at the head office of CEBL, or such other location in Ontario as the CEBL may determine.
Each Selected Entrant will be notified of their selection by the contact information provided at time of Entry. If a Selected Entrant cannot be contacted or fails to respond within forty-eight (48) hours of the first attempt of contact by the CEBL, they will be considered to have forfeited their Prize and will be disqualified and another Entrant may be selected from the remaining eligible Entries until such time as contact is made with a Selected Entrant or there are no more eligible Entries, whichever comes first (in which case the above-noted process will apply to such alternate Entrant). The CEBL will not be responsible for failed attempts to contact any Selected Entrant.
Limit of one Prize per Selected Entrant. If an Entrant is drawn as the Selected Entrant for more than one Team Draw, another Entrant will be selected from the remaining eligible Entries.
5. CLAIMING YOUR PRIZE:
To be declared a Selected Entrant, the Selected Entrant will be required to answer correctly, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question posed either by telephone or email at the telephone number or email address on the account of record for that Selected Entrant. The Selected Entrant will be required to sign a Declaration, Release and Waiver Form (the “Release Form”) confirming compliance with the Official Rules, acceptance of the Prize is awarded, without substitution, and releasing the Released Parties from any liability in connection with the Prize or the Contest. The Selected Entrant must complete and submit the Release Form within the timeframe indicated in the document.
The Selected Entrant acknowledges that the Released Parties have not been made, nor are in any manner responsible for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize, including, but not limited to, its quality, merchantability and fitness for a particular purpose. Further, no responsibilities are accepted for any additional expenses, omissions, delays, re-routing, or acts of any government or authority.
If the Selected Entrant does not meet all of the Contest requirements, fails to correctly answer the mathematical skill-testing question or does not sign and return the Release Form to CEBL within the time-frame specified, that Selected Entrant will forfeit their Prize and CEBL shall be entitled (but not obligated) to select another Entrant from the remaining eligible Entries until such time as contact is made with an Entrant or there are no more eligible Entries, whichever comes first. This process may continue until each Prize has been awarded or there is insufficient time to permit the awarding of any Prize (in which case the above-noted process will apply to such alternate Entrants). The Contest Sponsors are not responsible, whether because of human error or otherwise, for any failure to contact any Selected Entrant. CEBL will contact each Selected Entrant following receipt of their signed Release Form to arrange for delivery of the respective Prize.
The Prizes must be accepted as awarded. No substitution, assignment or transfer of a Prize is permitted.
6. PERSONAL INFORMATION:
By entering this Contest, each Eligible Participant acknowledges and authorizes the Contest Parties to use collected personal information for the purpose, or consistent purpose, of administrating the Contest in accordance with the Contest Sponsors’ Privacy Policy. 7. LIMITATION OF LIABILITY:
The Contest Sponsors reserve the right to terminate, suspend, modify, or withdraw from this Contest, in whole or in part, at any time and for any reason without prior notice. The Contest Sponsors also reserve the right to disqualify any individual who tampers with the entry process, violates the Official Rules and Regulations, or otherwise acts in a disruptive manner. Without limiting the foregoing, the Contest Sponsors may declare ineligible any individual who, in the Contest Sponsors’ sole judgment does not otherwise meet eligibility requirements or is otherwise in breach of these Official Rules and Regulations.
The Contest Sponsors reserve the right, in their sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in the Official Rules and Regulations, to the extent necessary, for purposes of verifying compliance by any entrant or Entry, with the Official Rules and Regulations, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Contest Sponsors in their sole and absolute discretion, affects the proper administration of the Contest as contemplated in the Official Rules and Regulations, or for any other reason. The Contest Sponsors reserve the right, in their sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Official Rules and Regulations, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. If due to printing, production, online, internet, computer, technical or other error of any kind whatsoever, more prizes are claimed than intended to be distributed or awarded according to these Official Rules and Regulations, then, in addition to having the right to terminate the Contest immediately, the Contest Sponsors reserve the right, in their sole and absolute discretion, to rescind invalid Prize claims and/or conduct a random draw from amongst all eligible Prize claimants to award the applicable Prize. The Release Parties’ total liability will be no greater than the approximate retail value of all the Prizes as stated above.
The Released Parties will not be liable for the failure of any Entry or other information to be received, captured or recorded for any reason. In no event will the Released Parties be liable to award more than four (4) Prizes, and do not accept responsibility, in whole or in part, for loss, damage or injury, howsoever caused in connection with the Prizes or the conduct of the Contest.
8. GOVERNING LAW:
The Contest shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Without limiting the generality of the foregoing, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations as between any person and/or Entrant and the Contest Sponsors in connection with the Contest shall be governed by and construed and interpreted in accordance with the internal laws of the Province of Ontario, Canada, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The Contest Sponsors, and all Entrants hereby attorn to the jurisdiction of the courts of that Province, sitting in the City of Toronto, Ontario, in respect of the determination of any matter, issue or dispute arising under or in respect of these Official Rules and/or the Contest and agree that any such determination shall be brought solely and exclusively before such courts.
The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.
Any words herein importing the masculine gender shall include the feminine gender and vice versa in both the singular and the plural.
